Key takeaways

  • The rule is one sentence long. A UAE residence permit becomes void if the holder stays outside the UAE for more than 180 consecutive days (Regulation Art. 59).
  • “Consecutive” is the key word. The count is of days in a row outside the country. Coming back resets it.
  • Eleven groups are exempt (Art. 60). Their residence stays valid until its end date, however long they are away. They include wives of foreign citizens, investors, students abroad, patients abroad, and some domestic workers.
  • Everyone else who goes past 180 days needs a return permit from GDRFA (Dubai) or ICP (other emirates) to come back on the same residence. Our re-entry permit guide covers the fees and how to apply.

This chapter explains the two articles behind the “six-month rule”: Article 59, which says when a residence becomes void, and Article 60, which lists who is exempt. For the practical steps, fees and a calculator, see our complete re-entry permit guide.

The rule

Article 59

When a residence becomes void: more than 180 consecutive days outside

Cabinet Resolution 65/2022

“The Residence Permit granted to the Foreigner shall be deemed void if the period of residence outside the State exceeds more than (180) one hundred and eighty consecutive days.”Cabinet Resolution No. 65 of 2022, Article 59

In plain English

  • If you stay outside the UAE for more than 180 days in a row, your residence permit is treated as void, even though its expiry date has not arrived.
  • The days must be consecutive. A trip back to the UAE, however short, restarts the count.
  • Day 180 itself is still inside the limit. The problem starts on day 181.

Example

Hassan leaves Dubai on 1 January and stays in his home country to care for his father. If he returns by 29 June (day 179), his residence is fine. If he is still away on 1 July, his residence is void under Article 59, unless he is in an exempt group or obtains a return permit.

What it means for you

Count the days from your last exit, not from the start of the year. If you will pass 180 days, apply for the return permit from abroad before you fly back. Our deadline planner shows day 180 for your exit date, and the re-entry permit guide explains the fees, conditions and how we file it.

Who is exempt

Article 60

The 11 groups whose residence stays valid

Cabinet Resolution 65/2022

“the Residence Permit shall continue to be valid until the end of its term for the following categories”Cabinet Resolution No. 65 of 2022, Article 60

In plain English

For these groups, the 180-day rule does not apply. Their residence stays valid until its normal end date:

#Exempt groupWhat it means in practice
1“The wives of foreign citizens” (official English wording)The English phrase is unusual and may reflect the Arabic wording for foreign wives of citizens. The Arabic text decides, so confirm with GDRFA or ICP before relying on it.
2Domestic workers accompanying Emirati students on scholarships abroadThe worker travels with the student
3Domestic workers accompanying sick Emirati citizens travelling for treatment abroadThe worker travels with the patient
4Foreign patients, and their companions, being treated abroadThey must hold valid residence and submit a medical report certified by the UAE authorities
5Domestic workers of UAE diplomatic and consular staff abroadThey must hold UAE residence
6Foreigners sent abroad by UAE public-sector bodies for training or courses, or working in their offices abroad, and their familiesThey must hold valid UAE residence
7Domestic workers of members of the ruling families working in their homes abroadThey must hold valid UAE residence
8Students enrolled at educational institutions outside the UAEThey must hold valid UAE residence
9Investors holding valid residence permitsThe investor, not automatically their family
10The UAE’s diplomatic and consular representatives, and those they sponsor who accompany themOfficial postings abroad
11Any other group excluded by the ICP Chairman or someone he authorisesThe person must hold valid residence and pay the prescribed fee

Example

Ayesha’s son studies at a university in Canada and holds a UAE family residence. As an enrolled student abroad (group 8), his residence stays valid even though he spends more than 180 days away. He should carry proof of enrolment when he travels back.

What it means for you

An exemption only works with proof: enrolment letters, medical reports certified in the UAE, or investor documents. Keep them ready for the airport and the airline. Partner and investor visa holders should read our investor and partner visa guide; their dependants are not automatically exempt.

Golden and Green residences

Article 60 does not list Golden or Green residence holders. Their absence rules come from their own provisions: the Golden residence annex and ICP’s service rules. Check your own category before a long trip.

The 180-day rule in UAE law: frequently asked questions

Which article of UAE law sets the 180-day rule?

Article 59 of Cabinet Resolution No. 65 of 2022, the Executive Regulation of Federal Decree-Law No. 29 of 2021. It says a residence permit is void if the holder stays outside the UAE for more than 180 consecutive days.

Who is exempt from the UAE 180-day rule?

Article 60 lists 11 groups, including investors holding valid residence, students enrolled abroad, patients being treated abroad with a certified medical report, some domestic workers, people sent abroad by UAE public-sector bodies, and any group excluded by the ICP Chairman.

Are investors exempt from the UAE 6-month rule?

Yes. Article 60 lists “Investors holding valid Residence Permits”. The exemption is for the investor; family members sponsored by the investor are not automatically covered.

Does a short visit to the UAE reset the 180 days?

Yes. Article 59 counts consecutive days outside the UAE, so entering the country breaks the run and the count starts again from your next exit.

What can I do if I have been outside the UAE for more than 180 days?

If you are not in an exempt group, apply from abroad for GDRFA’s or ICP’s permit to return on your existing residence. Our re-entry permit guide explains the conditions, fees and how we file it for you.

Please note. Quotes are from the official English translation on the UAE Legislation portal, checked on 30 September 2026; the Arabic text in the Official Gazette prevails, which matters especially for the wording of the exempt groups. Examples use invented names and are illustrative. This page is general information, not legal advice; the decision of ICP or GDRFA on your own file is final.
