Key takeaways
- If you are injured at work, the employer pays all treatment until you recover or a disability is confirmed: hospital, surgery, tests, medicines, rehabilitation, prosthetics and travel to treatment (Decree-Law Art. 37; Regulation Art. 23).
- Full wage for up to 6 months while you cannot work, then half wage for up to another 6 months (Art. 37(2)(b)).
- If a work injury or illness causes death, the family receives 24 months’ basic wage, no less than AED 18,000 and no more than AED 200,000, on top of the gratuity and other dues (Art. 37(3)).
- No compensation for self-inflicted injury, injury under alcohol or drugs, deliberately breaking displayed safety rules, wilful misconduct, or refusing treatment (Art. 38).
- Seven disciplinary penalties are allowed, from a written caution to dismissal, and only after a written investigation. Only one penalty per violation, and nothing for conduct outside work unless it is work-related (Arts. 39 and 41).
- Time limits protect workers: no charge more than 30 days after the violation is discovered, and no penalty more than 60 days after the investigation ends (Regulation Art. 24).
This chapter covers health and safety, what happens after a work injury, and how employers may discipline workers. We go through each article in order: a short quote from the official text, then what it means in simple words.
This page explains what the law says. To claim injury pay or challenge a penalty, see: How to file a MOHRE complaint · Labour dispute service.
Health and safety
Occupational safety and health
Federal Decree-Law 33/2021
“Establishments shall abide by the provisions contained in Federal Law No. (13) of 2020 Concerning Public Health”Federal Decree-Law No. 33 of 2021, Article 36
In plain English
Every company must follow the Public Health law and the rules made under it. The Executive Regulation sets out MOHRE’s role and the detailed safety duties (Regulation Article 22, below).
Example
A factory must meet both the labour law’s safety rules and the public health rules, for example on hygiene in workers’ areas.
Safety rules come from more than one law. If you see something dangerous, Article 45(3) lets you leave without notice in serious cases. See the chapter on ending a contract.
The employer’s safety duties, and the worker’s
Cabinet Resolution 1/2022
“Inform his workers, before handing over the work to them, of the risks associated with their professions”Cabinet Resolution No. 1 of 2022, Article 22(1)(c)
In plain English
The employer must:
- provide protection against work injuries, illness, fire and machinery risks;
- display clear safety and fire instructions, in Arabic and a language workers understand, with warning signs at danger points;
- tell workers about the risks of their job before they start;
- put a qualified person in charge of first aid and keep first aid kits stocked;
- provide fire extinguishers and prevention equipment;
- keep checking that workplaces stay safe, and reduce health hazards;
- protect against falls, falling objects, debris, sharp items, chemicals, hot, flammable or explosive substances, compressed gases and electricity;
- post technical instructions at machines, in Arabic and a language workers understand.
The worker must use the protective equipment and clothing provided, follow safety instructions, look after the equipment and not misuse or damage it. The employer may apply its penalty list to workers who break these rules.
MOHRE monitors that employers provide health insurance as the law requires, coordinates with health authorities, inspects, and penalises companies that break the safety rules.
Example
A worker on a building site refuses to wear his harness at height. The employer must provide the harness and train him on it, and can discipline him for not using it.
Not using the safety equipment provided can cost you injury compensation (Article 38) as well as lead to disciplinary action. Employers: the warnings and training must be documented.
Work injuries
Treatment, wages and compensation after a work injury
Federal Decree-Law 33/2021
“the value of the compensation shall not be less than eighteen thousand (18,000) AED and not exceed two hundred thousand (200,000) AED.”Federal Decree-Law No. 33 of 2021, Article 37(3)
In plain English
- A Cabinet resolution lists work injuries and occupational illnesses, and sets compensation for permanent total or partial disability and for death.
- After a work injury or occupational illness, the employer must pay for treatment until the worker recovers and can return to work, or a disability is confirmed.
- While the worker cannot work, the employer pays the full wage for up to 6 months. If treatment takes longer, half wage for up to another 6 months, or until the worker recovers, is declared disabled or dies, whichever comes first.
- If the injury or illness causes death, the family receives compensation of 24 months’ basic wage, at least AED 18,000 and at most AED 200,000. This is in addition to the gratuity and other dues.
Remember that a “work injury” includes an accident on your usual route to or from work (Article 1).
Example
Musa breaks his leg in a fall at work and cannot work for 8 months. His employer pays his treatment, his full wage for the first 6 months, and half his wage for the next 2.
Report a work injury to your employer straight away and keep every medical report. They prove the injury happened at work and how long you were unable to work.
What treatment the employer must pay for
Cabinet Resolution 1/2022
“The treatment cost shall include the costs of commuting the worker undertakes for the purposes of the treatment.”Cabinet Resolution No. 1 of 2022, Article 23(1)(d)
In plain English
- Treatment can be at any government or private health facility.
- The employer keeps paying until recovery, or until a disability is confirmed.
- It covers hospital stays, surgery, X-rays, lab tests, medicines, rehabilitation equipment, artificial limbs and prosthetics, and travel to and from treatment.
- The worker loses compensation if the injury came from deliberately breaking displayed safety instructions, but only if the employer had explained the instructions in a language the worker understands, warned about the risks, supplied protective equipment, and trained the worker.
- If the worker dies, compensation goes to those entitled under UAE law, or as the worker decided before death.
Example
An injured worker needs physiotherapy three times a week for two months. The sessions and the taxi fares to the clinic are the employer’s cost.
Employers cannot rely on a “safety violation” defence unless they can show they trained and warned the worker. Keep training records.
When there is no injury compensation
Federal Decree-Law 33/2021
“The injury occurred under the influence of alcohol, narcotics, or other psychotropic substances.”Federal Decree-Law No. 33 of 2021, Article 38(2)
In plain English
There is no compensation if the competent authorities’ investigation proves that the worker:
- deliberately injured themselves;
- was under the influence of alcohol, drugs or other psychotropic substances;
- deliberately broke safety instructions displayed in the workplace;
- was injured through their own wilful misconduct; or
- refused, without a serious reason, a medical examination or the treatment prescribed.
Example
A worker removes a machine guard against the posted instructions to work faster, and is injured. If the investigation confirms it was deliberate, Article 38(3) removes his right to compensation.
Follow the treatment the doctors prescribe. Refusing it without a good reason can cost you your compensation.
Discipline
The seven penalties an employer may impose
Federal Decree-Law 33/2021
“Dismissal from service while preserving the Worker’s right to end-of-service gratuity.”Federal Decree-Law No. 33 of 2021, Article 39(1)(g)
In plain English
- Written caution.
- Written warning.
- Deduction of up to 5 days’ wage a month.
- Suspension of up to 14 days, unpaid.
- Loss of the periodic pay rise for up to one year (where the company has periodic rises).
- Loss of promotion for up to two years (where the company has a promotion system).
- Dismissal, keeping the right to gratuity.
Example
A worker is late repeatedly despite a written caution. The next step can be a written warning, then a deduction, following the company’s penalty list.
Dismissal as a penalty under Article 39 expressly keeps your gratuity. Dismissal without notice is a separate route, allowed only on the grounds in Article 44, covered in the next chapter.
A fair process: notice, a hearing, and time limits
Cabinet Resolution 1/2022
“The worker shall not be accused of a disciplinary violation that has been discovered for more than (30) thirty days”Cabinet Resolution No. 1 of 2022, Article 24(4)
In plain English
- The penalty must be proportionate, judged by data breaches, safety impact, financial impact, harm to reputation, abuse of power, repeat offending, and any criminal or moral aspect.
- The employer must have a written penalty list covering the Article 39 penalties.
- No penalty without first telling the worker in writing what they are accused of, hearing their side, and recording it in a report on their file. The penalty, its reason and what happens on a repeat must be given in writing.
- No charge for a violation discovered more than 30 days earlier, and no penalty more than 60 days after the investigation ends.
- The worker can file a grievance with management, without being harmed for it, and keeps the right to go to MOHRE. Companies with 50 or more workers must publish their grievance rules and answer grievances in writing within a set time.
Example
An employer discovers in January that a worker broke a rule, but only raises it in April. Under Article 24(4) it is too late to charge him for it.
A penalty imposed without a written charge and a hearing breaks the Regulation. Ask for the investigation report and the written decision.
Suspension during an investigation, and other limits on penalties
Federal Decree-Law 33/2021
“It is not permissible to impose more than one disciplinary sanction for a single violation”Federal Decree-Law No. 33 of 2021, Article 41(2)
In plain English
- Investigation suspension: up to 30 days on half pay. If the case is closed, no violation is found, or only a warning is given, the withheld half is paid back.
- Criminal accusation (assault, theft, breach of trust and similar): suspension until a final decision, without pay. If the worker is released, acquitted of a non-felony, or the case is dropped for lack of evidence, they return to work with full back pay.
- No penalty for conduct outside the workplace unless it is connected to work.
- Only one penalty for a single violation.
Example
Rami is suspended on half pay for 20 days while a cash shortage is investigated. He is cleared, so the company pays him the other half of his wage for those 20 days.
An employer cannot give a written warning and a deduction for the same incident. Check any penalty letter for this.

Based on Decree-Law Article 37(2)(b) and 37(3). Disability compensation is set by a separate Cabinet resolution and is not included. An estimate, not a ruling on your case.
- The AED 200,000 cap starts at a basic wage of AED 8,333 a month. 24 × AED 8,333.33 = AED 200,000. Above that basic wage, the family receives the same maximum, so higher earners may want separate life or accident cover.
- The AED 18,000 minimum only matters below a basic wage of AED 750 a month (24 × AED 750 = AED 18,000). For almost every worker the 24-month formula, not the minimum, decides the amount.
- Death compensation uses the basic wage; the recovery wage does not say “basic”. Article 37(3) refers to the basic wage. Article 37(2)(b) refers to the wage. A worker whose basic wage is a small part of the package should keep the payslip showing both.
- After 12 months the wage duty ends, but treatment does not. Wages stop after 6 months full plus 6 months half. Treatment costs continue until recovery or until a disability is confirmed (Art. 37; Regulation Art. 23).
The disciplinary clock, step by step
Regulation Article 24 and Decree-Law Articles 39 to 41 set a strict order. A penalty that skips a step can be challenged.
- Day 0The employer discovers the violationThe 30-day clock starts from discovery, not from the date of the act.
- By day 30Written charge to the workerThe worker must be told in writing what they are accused of. After 30 days the charge is out of time (Regulation Art. 24(4)).
- InvestigationThe worker is heard, and it is recordedThe worker’s defence is heard and written into a report kept on their file. If needed, the worker can be suspended for up to 30 days on half pay (Art. 40).
- Within 60 days of the investigation endingWritten decisionThe penalty, the reason and what happens on a repeat, in writing. Only one penalty, from the list in Article 39 and the company’s written penalty list.
- After the decisionGrievance, then MOHREThe worker can file an internal grievance without being harmed for it, and keeps the right to go to MOHRE.
Penalty letter checklist
Received a warning, deduction or suspension? Check the letter against these eight points from Articles 39 to 41 and Regulation Article 24.

- Your side was heard and recorded in a report.
- The charge came within 30 days of the employer discovering the violation.
- The decision came within 60 days of the investigation ending.
- The decision is in writing, with the reason and what happens on a repeat.
- The penalty is one of the seven in Article 39 and on the company’s written list.
- It is the only penalty for that violation (Art. 41(2)).
- A deduction is no more than 5 days’ wage a month; a suspension is no more than 14 days.

Safety, work injuries and discipline: frequently asked questions
Who pays for treatment after a work injury in the UAE?
The employer, until you recover or a disability is confirmed. Under Regulation Article 23 this covers hospital stays, surgery, tests, medicines, rehabilitation, prosthetics and travel to treatment.
Am I paid while off work after a work injury in the UAE?
Yes. Article 37 gives full wage for up to six months while you cannot work, then half wage for up to another six months, or until you recover, are declared disabled or die.
How much compensation is paid if a worker dies from a work injury in the UAE?
24 months of the worker’s basic wage, no less than AED 18,000 and no more than AED 200,000, in addition to the end-of-service gratuity and other dues (Article 37(3)).
Can my employer suspend me without pay in the UAE?
As a penalty, for up to 14 days (Article 39). During an investigation, for up to 30 days on half pay, repaid if you are cleared or only warned (Article 40).
Can I be disciplined for something I did outside work?
Only if it is connected to work. Article 41(1) bans penalties for acts outside the workplace that are unrelated to work.
Is there a time limit for disciplinary action in the UAE?
Yes. Under Regulation Article 24(4), a worker cannot be charged for a violation discovered more than 30 days earlier, and no penalty can be imposed more than 60 days after the investigation ends.
When does the AED 200,000 cap on work injury death compensation apply?
When the basic wage is above about AED 8,333 a month, because 24 months of that basic wage exceeds AED 200,000 (Article 37(3)). Below a basic wage of AED 750 a month, the AED 18,000 minimum applies.
What happens after 12 months off work with a work injury?
The wage duty in Article 37 ends after six months at full wage and six months at half wage. The employer still pays treatment until the worker recovers or a disability is confirmed.
