Company Labour File Opening in Dubai

A trade licence lets you trade, not hire. Three separate registrations stand between your licence and your first employee — and quota is set by your office, not your plan.

The short version

  • A trade licence lets you trade. It does not let you hire. You need a MOHRE establishment file and an immigration file first.
  • Three registrations, in order: MOHRE labour file → immigration establishment card → quota approval.
  • Your quota caps how many people you can employ — and it is set by office space and activity, not ambition.
  • New companies routinely make an offer before any of this exists, then cannot onboard for a month.

The most common sequencing mistake we see from new businesses is hiring first and registering second. The licence arrives, the founder makes an offer, the candidate resigns from their current job — and only then does anyone discover there is no labour file, no establishment card and no quota.

All three are separate from the trade licence and from each other. Missing any one of them stops hiring completely.

The distinction worth internalising

The MOHRE file governs employment. The establishment card governs residency. You need both, they renew on different dates, and the establishment card is the one everyone forgets.

Quota — the constraint nobody plans for

Quota is the number of work permits your establishment is approved to hold. It is assessed on your office space, licensed activity and legal form — not on how many people you intend to hire.

Companies licensed on a flexi-desk or shared workspace frequently discover their quota supports one or two permits at most. If you plan to hire five people, the office decision and the hiring plan need to be made together — not six months apart.

Plan hiring around that. A candidate who resigns on Monday cannot start in two weeks if your establishment file does not yet exist.

Set it up right the first time

Three things are much cheaper to get right at registration than to fix later:

  • Quota headroom. Apply for what your twelve-month plan needs, not just your first hire. Increasing quota later means a fresh application and often a bigger office.
  • WPS registration. Set it up with an approved agent before your first payroll run, not after. Salaries are due on or before the 1st from your first month.
  • The renewal calendar. Licence, Ejari, establishment card and partner Emirates IDs all interlock. Put them on one calendar on day one.

Labour file questions

Can I hire staff as soon as I have a trade licence?

No. A trade licence authorises trading, not employing. You also need a MOHRE labour file, an immigration establishment card and quota approval before a single work permit can be issued.

What is a company quota in the UAE?

The number of work permits your establishment is approved to hold, assessed on office space, licensed activity, legal form and compliance history. It is not based on how many people you intend to hire.

How long before I can onboard my first employee?

Typically three to six weeks from trade licence to a first employee actually onboarded, covering labour file registration, establishment card, quota approval and then the work permit itself.

Can I increase my quota later?

Yes, through a separate application, but it is assessed against your office space and activity again — which often means taking larger premises. Applying for realistic headroom at registration is considerably cheaper.

Does a flexi-desk licence allow employees?

Usually only a very small number of permits, sometimes one or two. If you plan to build a team, the office decision and the hiring plan need to be made together.

Do free zone companies need a MOHRE labour file?

Free zones operate their own employment registration through the zone authority rather than MOHRE, but the underlying structure is the same — an employment registration, an immigration registration and a headcount allowance.
